Thank you for choosing one of the most unique properties on the Alabama Gulf Coast. Mariner Lakes-1 is a single family residence community that offers an ideal family oriented lifestyle on the beautiful Gulf Coast. The Owner's Association does currently allow owners the opportunity to offer short-term vacation rentals. Full time residents and owners at Mariner Lakes-1 want nothing more than for all quest to have a pleasant and memorable experience. The following rules and guidelines help to maintain and promote a friendly and harmonious community spirit:
Liability: Guest(s) agree to indemnify and hold harmless the Mariner Lakes-1 Property Owners Association (hereinafter "Association"), its directors, and owners for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the rental property, whether such risks be latent or manifest, including but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Guest(s). The Association is not responsible for the loss of money or valuables of any kind. The use of all facilities are at the risk of the user(s).
Unit Policy / Occupancy: Rentals are not allowed to anyone under the age of 25 nor are guest under the age of 25 allowed occupancy without being accompanied by a parent or legal guardian. The Total number of persons allowed in the unit at any one time is restricted by the City of Orange Beach Ordinance# 2018-1283, Sec.50-648:
2-Bedroom Units: 4 occupants plus two children age-14 or under
3-Bedroom Units: 6 occupants plus two children age-14 or under
NO "house parties" allowed. An atmosphere conducive to quiet enjoyment of guests must be maintained. Violations of over occupancy and/or disturbing the peace are grounds for ejection without refund.
Ejection or Removal: Property rentals at Mariner Lakes-1 are subject to the provisions of
"Section-54 / Article-III" of the Code of Ordinances of the City of Orange Beach. Guest expressly acknowledges and accepts the right of the Association, owner or owner's authorized agent to remove or cause the removal of guest and guest's invitees and permittees from the premises for any of the reasons enumerated, and in the manner provided in "Section 54-22". For example guest who, while on the premises of Mariner Lakes-1:
(1) Illegally possesses or deals in controlled substances as defined above, or who is intoxicated, profane, lewd, or brawling;
(2) Who indulges in any language or conduct which disturbs the peace and comfort of other guests or which injures the reputation, dignity, or standing of the premises;
(3) Who, in the opinion of the Association, its Board Member(s), or any owner, is a person whose continued stay would be detrimental to the premises.

This is not an exhaustive list of behavior that may cause ejection or removal of guests. Guest(s) who are ejected or removed agree that any monies paid to Owner or its Agent and any monies still owing to Owner or its agent are forfeit and deemed “used” in consideration for the time it would take to rebook Guest’s unit and/or the time and effort expended in removing or ejecting Guest.
Noise & Nuisance: No individual or group shall make or permit any noises that will disturb or annoy the occupants of any of the other guests or residents in the Mariner Lakes-1 community; nor should any individual or group conduct themselves in such a way which will interfere with the rights, comfort or convenience of others
Parking: NO PARKING ON GRASS - NO PARKING IN STREET - NO BOATS OR TRAILERS
Vehicles parked in violation of the following guidelines are subject to being towed at violators expense:
Park only in your driveway or in designated visitor parking areas. Two (2) cars may be parked in a single driveway if no portion of any vehicles protrudes into the street. Additional parking is available at the clubhouse and tennis court parking areas if all visitor spots are filled (3-day limit).
Driveways and parking areas must not be obstructed or encumbered or used for any purpose other than for parking automobiles only. No vehicle shall be parked in such manner as to block or impede normal street traffic. Automobiles may briefly park, with warning flashers on, for 20-30 minutes in front of a unit for loading or unloading.
No parking space, driveway, or other area shall be used for the storage or parking of any boat, boat trailer, house trailer, camper trailer, or any other sort of towed vehicle or object.
Drying Clothing / Towels: Under no circumstances shall laundry, towels, clothing, or other articles be placed or hung outside on decks, railings, or any exterior portion of any condo unit; this includes screen porches, trees, etc. Neither are toys, mats, coolers, chairs, etc. to be stored outside.
Charcoal Grills: Charcoal grills are NOT ALLOWED and are STRICTLY PROHIBITED for use anywhere on Mariner Lakes-1 property. Gas grills are allowed but may not be used under porches or within 10-feet of vinyl siding. Gas grills and tanks must be stored on rear decks and not enclosed in storage closets or garages.
Pets: Only unit owners and persons who have leased a unit for one (1) year or longer are allowed to have pets within any portion of the Association property. Short-term guest or renters are not allowed to have pets on the Association property.
Only two (2) pets per unit are allowed by property owners.
Pets must be under owner’s control and leashed at all times when outside. Dog walks are located in the grassy areas behind the tennis courts. Owner must clean and dispose of pet’s waste from all areas within the Villages of Mariner Lakes properties.
No pets are allowed within the gates of the pool area.
Loud excessive barking or noise from any pet is prohibited and shall be considered and treated as a public nuisance.
Clubhouse & Fitness Room: The clubhouse and fitness room are for use only by owners and persons who have leased a unit for one (1) year or longer. Short-term guest and renters are not allowed to utilize the clubhouse and its amenities. Persons under 18 years of age must be accompanied by a property owner at all times. Renters are not allowed to use the clubhouse.
Tennis Courts: Tennis courts are only to be used for playing tennis or pickleball. No other activities are to take place on the courts.
Children 12 and under must be supervised by an adult at all time.
Use of the tennis courts is on a first come, first serve basis. We ask that all owners and guest be respectful and considerate of their time and use of the courts.
No pets are to be allowed within the gates of the tennis courts.
No bicycles, roller skates, skateboards, scooter, or any other article with wheels are to be inside the gates of the tennis courts.
Court lights must be turned off by 10-pm.
GOLF CARTS AND MOTORCYCLES: Any operator must be least 16-years old and be valid licensed driver. Golf carts must always be operated in a safe manner and operated at or lower speeds than posted throughout the community.
Golf carts and motorcycles are not to be driven on or parked on any grass area with the Association property.
Short-term guest and renters are not allowed to bring in golf carts to the Association properties.
Garbage & Trash Disposal: Household garbage and trash is not to be stored outside of any unit at any time. All household garbage and trash should be gathered and contained in appropriate sized, tied garbage/trash bags.
Deposit of all household trash in the dumpster located at the south end of the Association property. The dumpster is strictly for household waste. All cardboard boxes are to be broken down prior to being placed in dumpster.
Do not place debris, demolition materials, discarded furniture, or any large and oversized items into the dumpster.
Do not place any item on the ground or against perimeter walls outside of the dumpster.
Parking in front of the dumpster is STRICTLY PROHIBITED.
Swimming Pool: Use of the pool area is seasonal. When open, the pool is available for use between the Hours of 7am – 10pm; this rule is strictly enforced. The pool All persons using the pool do so at their own risk. There is never a lifeguard on duty. The Association is not responsible for any accident, injury, or damage to personal property in connection with use of the pool. Persons using the pool area agree not to hold the Association liable for any actions of any nature occurring within the pool area.
The pool shall be used in accordance with such rules and regulations as shall, from time to time, be required by the Board of Health of Baldwin County, Alabama, and/or by the Association Board, which rules shall be visibly posted within the pool area by the Association Board of Directors.
Persons 12 and under must always be accompanied by an adult while at pool.
Infants and toddlers in diapers must wear swim diapers while in the water.
No glass containers, food, or pets are allowed within the pool enclosure area.
Except by prior arrangement with the Association Board, the number of persons in any one single group at the pool at any one time will not exceed the unit owner’s family plus three (3) guests.
Mariner Lakes-1 property owners are responsible for the conduct of their guests at all time, and for the careful observance of all safety and sanitation precautions.
No boisterous, rough or horseplay shall be permitted in the pool, or within the gates of the pool area. Swimming alone when not other person is in the immediate pool area is prohibited.
All guests, owners, and residents should cooperate in maintaining maximum cleanliness and tidiness in the swimming pool area. Pool furniture must be kept in proper order and returned to its original location and placement after use.
Amendment & Enforcement
These rules are subject to amendment by the Association's Board of Directors and to addition of further rules by the Board of Directors and/or by the Association.
Owners are responsible for supplying their guests, renters, long or short-term, with a copy of these rules and conveying to their guests and renters that all Association rules are strictly enforced.
Upon a finding by the Board of Directors, or their designee, that a violation has occurred o any of these Rules and Regulations, or any other aspect of the Condominium Documents, by any unit owner, or their guests, invitees, tenants, renters or other persons or parties invited by the unit owner or attending any function or activity sponsored by the unit owner, then that unit owner shall be responsible for such violation and the correction of same. The Board of Directors, or their designee, in addition to all rights and remedies provided in the Declaration for the enforcement of same, may impose a fine or monetary penalty upon such unit owner of an amount not to exceed $100.00 per day per violation, which shall be in addition to any costs or expense to repair or replace any item, property or thing removed, damaged or destroyed as a result or consequence of such violation, and which shall constitute a lien upon the unit and may be enforced the same manner as assessments under Section-11 of Declaration.
